DMCA Policy

Pinpinmo Inc. respects the intellectual property rights of copyright holders and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512, the "DMCA"). This policy describes how to report copyright infringement, how we respond, and how affected parties may contest a removal.

Designated Copyright Agent

Our designated agent to receive DMCA notices is:

DMCA Agent — Pinpinmo Inc.
Email: dmca@pinpinmo.com
Mailing address: Pinpinmo Inc., DMCA Department
88 Pine Street, Suite 2100
New York, NY 10005, USA

We strongly prefer email submission for speed and reliability. Mailed notices will be processed but may take 5–10 additional business days due to scanning requirements.

How to File a Takedown Notice

To submit a valid DMCA takedown notice under 17 U.S.C. § 512(c)(3), your written notice must include all of the following elements:

  1. Identification of the copyrighted work. A description of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notice, a representative list of those works.
  2. Identification of the infringing material. A description of the material you claim is infringing and its location on our platform — specifically, the URL(s) of the product listing(s) or page(s) containing the alleged infringement. Enough detail that we can locate the material.
  3. Your contact information. Your name, mailing address, telephone number, and email address.
  4. Good faith statement. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Signature. Your physical or electronic signature. For email submissions, typing your full legal name at the bottom of the email constitutes an electronic signature.

Warning about false claims. Misrepresenting that material or activity is infringing under 17 U.S.C. § 512(f) may subject you to liability for damages, including attorney's fees. Send notices only for material you genuinely believe infringes your copyright.

Our Response to Takedown Notices

Upon receipt of a complete, valid DMCA notice, Pinpinmo will:

  • Acknowledge receipt within 2 business days.
  • Review the notice for completeness. Incomplete notices will be returned with a description of what is missing.
  • If complete, promptly remove or disable access to the identified content (typically within 1–3 business days).
  • Notify the affected Creator that content was removed and provide them with a copy of the notice (with your contact details, as required by law).
  • Inform the Creator of their right to file a counter-notification.

Counter-Notification Process

If you are a Creator who believes content was removed due to mistake or misidentification, you may file a counter-notification under 17 U.S.C. § 512(g)(3). Your counter-notification must include:

  1. Your contact information. Your name, address, telephone number, and email address.
  2. Identification of the removed material. The specific URL or description of the content that was removed and its location on our platform before removal.
  3. Statement under penalty of perjury. A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Consent to jurisdiction. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the US, any judicial district in which Pinpinmo may be found), and that you will accept service of process from the person who filed the original DMCA notice.
  5. Your signature. Physical or electronic signature.

Send counter-notifications to dmca@pinpinmo.com. Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10–14 business days that they have filed a court action, we may restore the removed content at our discretion.

Repeat Infringer Policy

Pinpinmo maintains a repeat infringer policy. Creators whose stores are subject to three or more valid DMCA takedowns within a rolling 12-month period will have their store suspended pending review. Creators with five or more valid takedowns within any 12-month period will have their accounts permanently terminated and will not be permitted to open new stores on the platform.

Takedowns that are successfully counter-notified, resolved through retraction by the complainant, or that we determine to be abusive do not count toward this threshold.

AI-Generated Images and Copyright

Pinpinmo's platform uses AI image generation (including models from Wavespeed and similar providers) to create product images on behalf of creators. Our position is that AI training on publicly available internet data is lawful under current US copyright doctrine, including fair use principles discussed in connection with 17 U.S.C. § 107, and that AI-generated outputs — particularly those that do not reproduce substantial portions of any specific copyrighted work — generally do not infringe copyright.

We also recognize that the law in this area is evolving and that specific AI outputs may in some cases reproduce elements of training data in ways that could raise infringement concerns. We therefore:

  • Run AI-generated images through automated classifiers that attempt to detect outputs resembling known copyrighted characters or artwork before publication.
  • Respond promptly to valid DMCA notices regarding AI-generated content on our platform, regardless of how that content was generated.
  • Do not guarantee that every AI-generated image is free of third-party copyright claims.
  • Work with rights holders and our AI generation partners to improve detection and reduce the likelihood of infringing outputs.

If you are a rights holder with concerns about AI-generated content on Pinpinmo that resembles your protected work, we encourage you to contact dmca@pinpinmo.com with details so we can investigate and, where appropriate, remove the content.
